This Site Users Agreement (“Agreement”) states the terms and conditions that govern the use of the websites (“Sites”) of MountainOne Financial Partners, Inc. (MOFP), Hoosac Bank, Williamstown Savings Bank, South Coastal Bank, True North Financial Services, Inc., True North Insurance Agency, Inc. (dba MountainOne Insurance Agency, Inc. in California) and Coakley, Pierpan, Dolan & Collins Insurance Agency, Inc. (“CPDC”). 

Please read these terms of use carefully as they exclude or limit the liability of the aforementioned entities and set forth the terms and conditions that apply to your use of the Sites.  By using any one of the Sites you agree to be bound by the Terms of this Agreement for the use of all Sites and accept these terms in full.    

When you use or access, or permit any other person(s) or entity to use or access these Sites, you agree to the terms and conditions of this Agreement.  We may amend or change this agreement from time to time, in our sole discretion, by posting the updated terms on the Sites.  You will need to access and review this Agreement regularly.  If you find the Agreement unacceptable to you at any time, please discontinue your use of the Sites immediately.  Your use of the Sites after we have made such changes available will be considered your agreement to the change.

The availability of products and services described on the Sites, as well as associated fees, charges, interest rates, and balance requirements may differ among geographic regions.  Your eligibility for products or services described in the Sites is subject to approval.  No solicitation is made by any of the affiliated entities to any person to use any information, product, services, or materials in any jurisdiction where such information, products, services, or materials is prohibited by law.

Disclaimer of Warranties

Access to and use of the Sites is at your own risk and MountainOne or its suppliers does not warrant that the use of these Sites or any material downloaded from it will not cause damage to any property, or otherwise minimize or eliminate the inherent risks of the internet including but not limited to loss of data, computer virus infection, spyware, malicious software, Trojans and worms.  Also, MountainOne accepts no liability in respect to losses or damages arising out of changes made to the content of the Site by unauthorized third parties.

The information contained in these Sites, including texts, graphics, links, or other times are provided “as is”.  Neither MountainOne nor its suppliers warrants the availability, accuracy, adequacy, completeness or timeliness of the information, materials, products and services accessed on through the Sites and expressly disclaims liability for errors and omissions in the information or materials accessed on or through the Sites.  No warranty of non-infringement, title, merchantability, fitness for a particular purpose and freedom from computer virus is given in conjunction with the information, materials, products or services.

Submissions

All information submitted to MountainOne via these Sites shall be deemed and remain the property of MountainOne, and MountainOne shall be free to use, for any purpose, any idea, concepts, know-how or techniques contained in such information. 

Limitation of Liability

IN NO EVENT SHALL MOUNTAINONE OR ITS THIRD PARTY SUPPLIERS BE LIABLE FOR ANY DAMAGES, LOSSES OR LIABILITIES INCLUDING WITHOUT LIMITATION DIRECT OR INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR OTHER DAMAGES, LOSSES OR EXPENSES ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OF THIS SITE OR RELIANCE ON OR USE OR INABILITY TO USE THE INFORMATION, MATERIALS, PRODUCTS OR SERVICES ON THIS SITE, OR IN CONNECTION WITH ANY FAILURE OF AVAILABILITY, PERFORMANCE, ERROR, OMISSION, INTERRUPTION, DEFECT, DELAY IN OPERATION OR TRANSMISSION, COMPUTER VIRUS OR SYSTEM FAILURE, EVEN IF MOUNTAINONE OR ITS THIRD PARTY PROVIDERS ARE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, LOSSES OR EXPENSES.  THE FOREGOING LIMITATION MAY NOT APPLY TO THE EXTENT SUCH LIMITATION IS PROHIBITED BY APPLICABLE LAW.

Indemnification

You agree to defend, indemnify and hold harmless MountainOne, its affiliates and respective directors, officers, employees and agents from and against all claims and expenses, including attorneys’ fees, arising out of your violation of these Terms of Use or misuse of these services or these Sites, including such violation or misuses by your employee or agent, if applicable.

Governing Law and Jurisdiction

You agree that your use of the Sites shall be governed by all applicable Federal Laws and the laws of the Commonwealth of Massachusetts without giving effect to any principles of conflicts of law.  You expressly agree to submit to the sole and exclusive jurisdiction of the state and federal courts sitting in the State of Massachusetts.

Products

Securities and investment advisory services are offered through Commonwealth Financial Network^®, Member FINRA/SIPC, a Registered Investment Adviser.  Fixed annuities and insurance products are provided by various insurance companies and offered through True North Insurance Agency, Inc., doing business as MountainOne Insurance Agency in California.  Products and services are available to persons in the United States only.  Products are not available in all states.

Credit

The purchase of insurance from TNIA or CPDC is not required to obtain credit or other services from Hoosac Bank, Williamstown Savings Bank or South Coastal Bank.
